Noctave — Terms of Use

These Terms of Use ("Terms") govern your use of Noctave, an overnight snore & sleep audio recorder for iPhone. Please read them carefully.

1. Acceptance

By downloading, installing, or using Noctave, you agree to these Terms. If you do not agree, please do not use the app.

2. License to use the app

We grant you a personal, non-commercial, non-exclusive, non-transferable, revocable license to use Noctave on Apple devices that you own or control, in accordance with these Terms and Apple's usage rules. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.

3. Your content

Noctave records audio while you sleep and stores those recordings on your device. You are solely responsible for the recordings you create and for keeping your own backups. Your recordings stay on your device; the developer cannot access them. We recommend keeping your device backups current so you do not lose recordings you want to keep.

4. Subscriptions

Noctave offers Noctave Plus, which unlocks the app's full experience. Noctave Plus is available in three options:

Weekly subscription — includes a 3-day free trial, then auto-renews weekly.
Annual subscription — auto-renews yearly.
Lifetime — a one-time purchase, no renewal.

Purchases are processed by Apple and charged to your Apple ID / App Store account.
The Weekly and Annual subscriptions auto-renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time in your App Store account settings.
The price and billing period are always shown before you buy. If you start a free trial and do not cancel before it ends, it converts to a paid subscription at the standard price.
The Lifetime option is a one-time purchase and does not renew.

5. Apple's Standard EULA

In addition to these Terms, your use and any purchases are also governed by Apple's Standard End User License Agreement (the Licensed Application EULA), available at:

6. Disclaimer of warranties

Noctave is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted operation. We do not guarantee that the app will be error-free, or that snore detection or reports will be accurate for your situation.

Medical disclaimer. Noctave is not a medical device. It does not diagnose, treat, or monitor sleep apnea or any other medical condition. It is for general informational and personal-interest purposes only. Consult a qualified healthcare professional for any sleep or health concerns.

7. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or recordings, arising out of or related to your use of Noctave. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.

8. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of Noctave after changes take effect constitutes acceptance of the updated Terms.
